Sales Conditions
These Sales Conditions are applicable to the Oakland Rise Multi-Unit Land Release in June 2026.
Capital Estate Developments strongly recommends that prospective purchasers:
a) obtain independent legal and financial advice about the purchase of land in the Oakland Rise Multi-Unit Land Release June 2026; and
b) make their own enquiries and undertake their own due diligence with regards to the accuracy of the information contained in the sales documents
These Sales Conditions are to be read in conjunction with all documents included in the template form of contract for the sale of land and block plans.
Expression of Interest
1. To submit an expression of interest to purchase a block in the Oakland Rise Multi-Unit Land Release June 2026 (Oakland Rise Block), you must complete and send a copy of the Request for Expressions of Interest Sales Document to sales@capitalestate.com.au, or complete and submit the online Oakland Rise Multi-Unit Land Expression of Interest form (EOI)
2. You must ensure that your completed EOI includes the full legal names (including any middle names) of all persons and, if applicable, the names of all corporate entities which will be inserted into the contract for sale of land as purchaser if you are successful in being allocated an Oakland Rise Block.
3. Only the persons and/or corporate entities included in your completed EOI can be included as the purchaser in the contract for sale for the Oakland Rise Block.
4. By submitting an EOI you agree to comply with the Sales Conditions.
5. EOIs will not be accepted after 2pm (Australian Eastern Standard Time) on Friday 17 July 2026 (EOI Close).
6. If, after submitting an EOI, you wish to amend any of the information you have provided, you may do so by sending an email to sales@denmanprospect.com.au prior to the EOI Close.
7. You will not be permitted to make any amendments to your EOI after the EOI Close.
Eligibility Criteria
8. To qualify to submit an EOI and, if successful, enter into a contract for sale to purchase an Oakland Rise Block you must be:
a) an individual aged 18 years or older; or
b) a corporation that is registered under the Corporations Act 2001 (Cth).
9. You, or a Related Party to you, may only purchase one Oakland Rise Block in this release.
10. Where you are a person, a “Related Party” to you is:
c) your spouse or domestic partner; or
d) a company of which you are a director, secretary or shareholder; or
e) a company of which your spouse or domestic partner is a director, secretary or shareholder.
11. Where you are a company, a “Related Party” to you is:
a) a director, secretary or shareholder of that company; or
b) a person who is a spouse or domestic partner of a director, secretary or shareholder of that company; or
c) a company which has a director, secretary or shareholder in common with that company; or
d) a company which has as a director, secretary or shareholder, the spouse or domestic partner of whom is a director, secretary or shareholder of that company.
12. Your EOI may not be considered if:
a) you provide false or misleading information in the EOI;
b) you have not completed or have failed to include all details specified in the EOI;
c) the personal details provided in the EOI do not match the details on your photo identification or proof of residential address documents;
d) the details of the company you propose as purchaser do not match the details held by the Australian Securities and Investments Commission; or
e) the EOI is submitted after the EOI Close.
Oakland Rise Block Allocation
13. Capital Estate Developments will endeavour to allocate Oakland Rise Blocks based on the preferences provided in your EOI. You can indicate your preference for up to four (4) Oakland Rise Blocks in your EOI. You should only include those Oakland Rise Blocks in your preferences that you are willing and able to purchase.
14. There is no guarantee provided by Capital Estate Developments that you will receive your first or any subsequent preference.
15. In assessing EOIs, Capital Estate Developments will favour those applicants who have been unsuccessful in prior land releases at Denman Prospect.
16. If multiple applicants apply for the same Oakland Rise block, Capital Estate Developments will exercise its sole discretion when allocating those blocks. Capital Estate Developments will not enter into further discussion regarding block allocations.
17. Applicants will be notified whether they will be offered the opportunity to purchase an Oakland Rise Block by 2pm Friday 24 July 2026.
18. Capital Estate Developments may, in its sole and absolute discretion, accept or reject any EOI at any time and exclude an applicant from further participation in the EOI or sales process even if they have been offered an Oakland Rise Block.
19. Capital Estate Developments or its legal advisors may make further enquiries and request any additional information or documentation that is deemed necessary, from you or any other persons, at any time and for any reason in connection with the Oakland Rise Land Release including requesting statutory declaration(s) as to relevant facts or matters and/or interviewing you.
20. Noting paragraph 9 (Eligibility Criteria), where multiple EOIs from the same or Related Parties are submitted, Capital Estate Developments may contact the applicant to confirm which EOI they wish to progress.
Contract Exchange
21. If you are successful in being offered an Oakland Rise Block and notify Capital Estate Developments that you wish to proceed with the purchase of that block, you or your appointed agent must provide Capital Estate Developments or its solicitor with valid photo identification for you (e.g. driver’s licence or passport) and proof of your current residential address (e.g. driver’s licence, current bank statement, public utility invoice or other proof of address acceptable to Capital Estate Developments). The details on your identification must match the information provided in your EOI.
22. Your Oakland Rise Block will be sold to you on the terms of the draft contract for sale and Capital Estate Developments will not agree to amend those terms.
23. Additions or changes to your details will only be permitted in limited circumstances to correct minor and insignificant errors (for example, to correct errors of a typographical nature or to correct an accidental omission of your middle name).
24. Parties that are successful in being offered an Oakland Rise Block will be required to exchange contracts by 31 July 2026. You will be required to pay 5% of the total purchase price of your allocated block at the time of contract exchange.
25. Payment can be made by electronic transfer or by bank cheque. Credit cards, cash or personal cheques will not be accepted.
